Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kindred Connections website and the Bailey AI companion service (collectively, the "Service") provided by Kindred Connections, Inc. ("Kindred Connections," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account. The Bailey companion experience is intended for adults 65 and older; accounts may be created by adult family members or facility staff on a senior's behalf.

2. Description of Service

Bailey is an AI-powered companion application that provides voice-based conversation, medication reminders, life story preservation, and family communication features. The Service is provided on a subscription basis. AI responses are generated by large language models and are not medical advice. Bailey is not a substitute for professional healthcare, emergency services, or human caregiving.

3. Account Registration

You agree to provide accurate and complete information when creating an account and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use at hello@kindredconnections.co.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to harass, abuse, or harm another person
  • Attempt to reverse-engineer, decompile, or extract the AI model
  • Resell or sublicense access to the Service without written authorization
  • Upload content that infringes third-party intellectual property rights
  • Use the Service to generate or distribute spam or malicious content
  • Attempt to circumvent security, rate limits, or access controls

5. Subscription and Payment

Pricing for subscriptions is available on our Pricing page or by contacting us. Subscriptions auto-renew until cancelled. You may cancel at any time; cancellations take effect at the end of the current billing period. All fees are non-refundable except as required by law.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Kindred Connections and are protected by US and international intellectual property laws. You retain ownership of content you provide (voice recordings, photos, stories). By uploading content, you grant Kindred Connections a limited license to store and process it solely to provide the Service.

7. Not Medical Advice

Bailey is not a medical device, clinical tool, or licensed healthcare provider. Nothing in the Service constitutes medical advice, diagnosis, or treatment. In an emergency, call 911 or your local emergency number immediately.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDRED CONNECTIONS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account immediately, without notice, if you breach these Terms. You may terminate your account at any time by contacting hello@kindredconnections.co.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

12. Dispute Resolution

Any dispute arising from these Terms shall first be submitted for informal resolution by contacting us at hello@kindredconnections.co. If not resolved within 30 days, disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
